Terms of Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern all online sales by Accurate Technologies (UK) Ltd (“Seller”) to business customers (“Buyer”) via our UK eStore. By placing an order, the Buyer agrees to be bound by these Terms.


2. Products

Products include data acquisition hardware, dataloggers, CANbus tools and related equipment. All descriptions and specifications are subject to change without notice.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

 

3. Orders and Acceptance

Orders constitute an offer by the Buyer to purchase products in accordance with these Terms. Acceptance occurs only when the Seller issues written confirmation or dispatches the goods.


4. Prices and Payment

Prices are as displayed on the website and include VAT unless otherwise indicated. Payment must be made in full prior to dispatch.


5. Delivery

Delivery dates are estimates only and time shall not be of the essence. Risk passes on delivery; title passes upon receipt of full payment.


6. Right of Cancellation (Consumer Sales only)

Consumers may cancel within 14 days of receipt pursuant to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Details of the cancellation procedure are provided separately in the Returns Policy.


7. Warranties and Disclaimers

The Seller warrants that products shall conform materially to their specifications at the time of delivery. Except as expressly provided, all other warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability or non-infringement, are excluded to the fullest extent permitted by law.


8. Limitation of Liability

To the maximum extent permitted by law, the Seller’s total aggregate liability arising out of or in connection with any contract shall not exceed the price paid for the goods giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot lawfully be limited.


9. Force Majeure

The Seller shall not be liable for any delay or failure due to causes beyond its reasonable control.


10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.


11. Acceptance of Terms – Checkout Consent

At checkout, customers must confirm acceptance of these Terms by ticking the following box:

“I confirm that I have read and agree to the Terms and Conditions of Sale.”
